This Privacy Policy (“Privacy Policy”) describes the practices of Linq Venture Holdings LLC d/b/a Wabash Marketplace (“Company” or “we” or “us”) for collecting, using, storing, disclosing, and otherwise processing information that identifies or may reasonably be used to identify you (“Personal Information”) that we may collect or that you may provide us from your interaction with our websites (https://marketplace.onewabash.com/ and TrailerHawk.ai),  support service webforms, and online applications (our “Platforms”).

By using our Platform you acknowledge this Privacy Policy and the collection, use and disclosure of your Personal Information.  Please read this Privacy Policy carefully to understand our policies about how we treat your Personal Information.
To the extent you are accessing this Platform in your capacity as an employee or contractor of a customer of Company, the contract between Company and your employer governs our use and collection of your Personal Information and not this Privacy Policy.  You may consult your employer for additional information.

Information We Collect About You

We collect the following types of  Personal Information about you in the following different ways:
a. Personal Information You Provide via our Platform:
• Identifying information consisting of your first name and last name, employer’s name, job title, email address, phone number, physical mailing address, age, unique identifiers, and your Internet Protocol (IP) address.
• Account Information consisting of username and password.
• Geolocation Information consisting of your precise GPS location (with your consent), imprecise geolocation, and information regarding Wi-Fi access points and cell towers to which your device is connected to. The types of location data we collect will depend in part on your device and account settings.

b. Personal Information Collected by Automated Technologies:
• Device Information consisting of internet protocol (IP) address, mobile carrier name, hardware information, operating system, platform information, application version (if application is used) browser type, language information, and browser plugin types, and sensor data from your device.
• Usage Information consisting of information about how you use and interact with our Platforms, including browsing history, search history, and which website you came from and the date and time of your visit.
We may associate Personal Information collected by automated technologies and combine it with other Personal Information about you or your account.

We may collect Personal Information about you from related companies, affiliates, joint ventures or third-party companies that provide services that are used together with the Platform. Disclosure of Your Personal Information

We may disclose Personal Information with third parties for certain purposes. The categories of third parties to whom we disclose your Personal Information and the reasons for such disclosures are as follows:
• Service providers and subcontractors to operate our Platform and Services. We disclose your Personal Information with our vendors, service providers, and subcontractors for operating and maintaining our Platform, and its features and functionalities . These third parties include data hosting and data storage partners, analytics,, technology services and support, and data security. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

This Platform uses various third party automated pixel tags, cookies, web beacons and similar tracking technologies to collect Personal Information, including the default Adobe Commerce, Google Analytics, Google Tag Manager, and Magento Open-Source cookies, which third parties provide services to us.  However, these third parties may also use this Personal Information for purposes other than services to us and we do not control these third parties' privacy policies. Retention of Your Information

We retain your Personal Information for as long as necessary to provide you products and services, and to fulfill or meet the reason you provided the Personal Information, and in accordance with our data retention schedule. We provide you with various choices on how you can opt out of our certain uses and sharing of your Personal Information. As a general rule, you cannot opt out of our collection, use and sharing of Personal Information to the extent it is necessary to provide the Platform or related basic services.

Our Platform is not intended for children under 18 years of age. No one under age 18 may provide us with any Personal Information on or through the Platform. International Users

Our Platform is not intended for use by and is not directed to residents of the European Union and other countries outside of the United States. All data is stored and processed in the United States. Your Personal Information is transferred by Company to another country only if it is required or permitted under applicable data protection law and provided that there are appropriate safeguards in place to protect your Personal Information. NOTICE TO CALIFORNIA CONSUMERS

We have not used or disclosed Sensitive Personal Information for any reason other than the reasons for which it was provided to us and we do not use Sensitive Personal Information to infer characteristics about you.

Purposes for Collecting Personal Information.
We use the categories of Personal Information listed above for the business purposes as disclosed in Section 2 (Reasons for Collecting Your Personal Information).

Categories of Our Service Providers or Contractors with Whom Personal Information is Disclosed for a Business Purpose.  
In the last 12 months we have disclosed all the categories of Personal Information listed above for our business purposes. The categories of Service Providers or Contractors with whom we disclose Personal Information in the last 12 months are described above in Section 4 (Disclosure of Personal Information).

Categories of Third Parties with Whom Personal Information is Sold or Shared.  
In the last 12 months we have not Sold or Shared Personal Information of any individual for compensation or cross-contextual behavioral advertising and we currently do not Sell or Share Personal Information. We do not have any actual knowledge that we have Sold or Shared Personal Information of any individual under the age of 16 for monetary compensation or for cross-context behavioral advertising.

Your California Privacy Rights California Consumers have the right to make the following requests:
• Right to Know and Access.  You have the right to request that we disclose the following information to you regarding our collection and use of your Personal Information over the past 12 months::
     The categories of Personal Information we have collected about you;
      The categories of sources from which we collect the Personal Information about you;
      The business or commercial purpose(s) for which the Personal Information was collected, sold, or shared;
      The categories of third parties with whom we disclose that Personal Information for a business purpose;
      The specific pieces of Personal Information we collected about you in a format easily understandable to the average Consumer; and
      The categories of Personal Information that we sold or shared, and the categories of third-party recipients to whom it was sold or shared.

• Right to Opt-out of “Sale” and Certain “Sharing” Practices. You have the right to opt-out of the “sale” and “sharing” of your Personal Information with third parties, as those terms are defined under CCPA.  However, as noted above, we do not Sell or Share Personal Information.
• Right to Correct. You have the right to request that we correct inaccurate Personal Information that we maintain about you that you can prove is inaccurate.  
• Right to Non-Discrimination. We will not discriminate against you for exercising any of your rights under the CCPA.  

How to Exercise Your California Consumer Rights.

Verifiable Consumer Request.  
In order to verify your request, we may require additional information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. This information may vary depending on the Personal Information we already have. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why. We may reject or deny your request as permitted or as required by law. We may charge a fee as permitted by the CCPA, such as to process or respond to your request if it is excessive, repetitive, manifestly unfounded, or if we believe the request is fraudulent or submitted for purposes other than exercising applicable privacy rights.

Authorized Agents.
You may only make a request to exercise your rights on behalf of yourself, or a parent or legal guardian may make a request on behalf of their minor child. You also have a right to submit requests to exercise your rights under the CCPA through an authorized agent. If an authorized agent contacts us to exercise the above rights, we will need to verify their identity as well as your identity. We will also require proof of your written authorization to the agent to be your agent and to make the specific request submitted, unless the agent is subject to a Power of Attorney under California probate laws. If the agent is a Power of Attorney under California probate laws, we may require evidence of that status.

Nebraska Consumers have the right to make the following requests with regard to their Personal Data:

If we deny your appeal, you may have the right to appeal to the Nebraska Attorney General.
